Acumen provides an AI chatbot platform that businesses embed on their websites to handle support inquiries, generate leads, and route conversations to human operators when needed.

To create an account, you must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate information during signup and to keep your account credentials secure. You are responsible for all activity under your account.

Acumen offers an opt-in SMS notification service for designated operators on a customer account.

Program description:Operators receive text message alerts when a website visitor on the customer’s site requests human handoff from the AI chatbot, or when other conversation events configured by the customer occur.

How to opt in: Provide your mobile number and confirm consent during account setup or when adding your number to operator notification settings inside the Acumen dashboard.

Message frequency:Message frequency varies based on visitor activity on the customer’s website.

Cost: Message and data rates may apply. Acumen does not charge for SMS notifications, but your wireless carrier may charge you for receiving them.

Supported carriers:The service is available on major US carriers, including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.

Opt out: Reply STOP to any message to unsubscribe. You will receive a confirmation text, after which no further messages will be sent unless you re-enroll through your account settings.

Privacy: Your mobile information is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

You agree not to use the Acumen service to:

• Violate any law or regulation
• Send spam, unsolicited messages, or content that violates messaging regulations including TCPA, CAN-SPAM, and CTIA guidelines
• Harass, threaten, defame, or harm others
• Distribute malware or attempt to compromise the security of the service
• Impersonate any person or misrepresent your affiliation with any entity
• Scrape, copy, or reverse engineer the service
• Use the service to compete with Acumen or build a similar product

If you deploy Acumen on your website to interact with your own users, you are responsible for:

• Posting your own privacy policy that discloses use of the chatbot
• Obtaining any required consent from your end users
• Complying with applicable laws governing the data you collect through the service
• The conduct and content of operators acting on your behalf

Paid plans are billed according to the pricing displayed at the time of signup. Fees are non-refundable except as required by law. We may change pricing with prior notice. Continued use after a price change constitutes acceptance.

The Acumen service, including all software, content, and branding, is owned by Acumen and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms. You retain ownership of any content you upload or generate through the service, and you grant us a license to process that content as needed to provide the service to you.

The service integrates with third-party providers including Twilio for SMS delivery, Stripe for payments, and others. Your use of those integrated features may also be subject to the terms of those providers.

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. AI-generated chatbot responses may contain inaccuracies, and you are responsible for reviewing outputs before relying on them.

To the maximum extent permitted by law, Acumen and its operators, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim related to the service will not exceed the greater of one hundred US dollars or the amount you paid to Acumen in the twelve months before the claim arose.

You agree to indemnify and hold Acumen harmless from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our discretion, is harmful to the service or other users. You may cancel your account at any time through your account settings. On termination, your right to use the service ends, and we may delete your account data after a reasonable period.

We may update these Terms from time to time. If we make material changes, we will provide notice through the service or by email. Continued use of the service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of [STATE], without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in Fort Bend County, TX, and you consent to the jurisdiction of those courts.
